Upon booking confirmation with Natalie Ong, hereinafter referred to as the “Photographer”, the client, hereinafter referred to as the “Client” agrees to the terms and conditions outlined below:
1. PHOTOGRAPHY SERVICES
The Photographer agrees to provide photography services for the Client as outlined in the package details discussed and agreed upon by both parties.
2. PAYMENT
a. 50% Deposit upon booking confirmation.
b. The remaining 50% fee to be paid before the Photographer releases the final deliverables.
c. The Photographer reserves the right to withhold deliverables until full payment is received.
d. Additional fees may apply
– Overtime/Late-shows: RM100 per every 30 minutes
– Weekend/Public Holiday photoshoots: RM200
– Interstate bookings (Photoshoots & Competition Coverages):
– Additional travel and/or accommodation fees depending on duration and location
3. CANCELLATION AND RESCHEDULING:
Cancellation:
Cancellations can be made 48 hours prior to the photoshoot/competition event.
Refund Policy:
a. Cancellation with 48-Hour Notice:
Deposits can be refunded in the event of cancellation by the Client with a 48-hour notice.
b. Cancellations within 24 Hours:
Deposits will not be refunded for cancellations made within 24 hours prior to the booking, (Unless due to unforeseen circumstances or emergencies, the Photographer reserves the right to determine if a refund or rescheduling can be arranged).
c. Cancellations due to Unforeseen Circumstances:
Deposits will not be refunded for competitions and class bookings affected by unforeseen circumstances, such as competitions ending prematurely due to rider faults, injuries, weather, etc.
4. CONFIDENTIALITY:
Both parties agree to treat all details of the photoshoot and any information shared (Such as the Photographer’s rates) during the collaboration as confidential.
5. DELIVERABLES:
a. The Photographer agrees to provide the Client with high-resolution edited images and/or videos from the photoshoot/event, with the specific number and details is outlined in the photography packages chosen by the Client.
b.The Photographer will deliver the edited images to the Client via Google Drive within 1 week of the photoshoot/competition event.
c. Any additional services or specific deliverables beyond the agreed-upon scope may incur extra charges, which will be discussed and mutually agreed upon by both parties if needed.
6. COPYRIGHT & OWNERSHIP OF IMAGES:
a. The Client is granted a non-exclusive, non-transferable license for personal use only.
b. The Photographer retains the copyright to all images and reserves to right to pursue legal action or charge additional fees for any unauthorized use or infringement of copyright.
7. PHOTOGRAPHER RELEASE:
The Client reserves the rights to use the deliverables for personal use only:
For the purposes of this Agreement, “personal use” is defined as personal collection, non-commercial keepsake prints, and content for their own social media profiles only.
8. RESTRICTIONS ON USAGE:
a. The Photographer prohibits the use of the photographs for any commercial purposes, including but not limited to advertising, stock photography, merchandising, or any other commercial ventures without the Photographer’s prior written consent.
b. Use of photos for social media competitions/give-aways hosted by brands or sponsors on social media will require my permission and may incur a commercial license fee for accounts that intend to use the photos as content.
c. Any unauthorized use, reproduction, or distribution of the images is strictly prohibited.
d. The Photographer reserves the right to utilize photos & videos for content creation, however, if you prefer that your images not be shared online, please inform the Photographer beforehand.
9. CLIENT SATISFACTION:
The Photographer will make reasonable efforts to ensure the Client’s satisfaction.
If the Client is unsatisfied with the final images, the Photographer may, at her discretion, offer additional editing.
10. RELEASE OF LIABILITY:
a. The Client understands that photography sessions/events involving horses are subject to certain risks and hazards.
b. The Client is by default, voluntarily assuming all risks associated with the photography session/event, including but not limited to any risks of injury, property damage, or other harm to their person or their horses, whether foreseen or unforeseen

The Photographer will not be held accountable and is released from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Client or any of their property, including but not limited to their horses, tack and equipment, clothing or environmental property, whether caused by the negligence the Photographer or otherwise.
